Terms of Service

BackToSchoolPlan (“BackToSchoolPlan,” “we,” “us,” “our”) is a free, public resource operated by MyTherapy LLC, doing business as Bia (“Bia,” the “Company”) — the same company that operates the Bia phobia-recovery app at biajourney.com. BackToSchoolPlan and Bia are run by one company under one set of policies.

BackToSchoolPlan itself is an informational website. The school-return plan builder runs in your browser. The suggested steps, the pattern read-out and the step breakdowns come from Bia over anonymous, stateless requests described below; nothing about you is sent with them, and the tool keeps working if they fail or are blocked. If you choose to continue to Bia and create an account, Bia’s own Terms of Service and Privacy Policy — which are this same company’s policies — also apply to your use of Bia.

These Terms of Service (“Terms”) govern your use of the BackToSchoolPlan website at backtoschoolplan.com, including the builder, the step catalog, and all other content and services we provide (the “Services”). Together with our Privacy Policy and Cookie Policy, they form a legally binding agreement between you and MyTherapy LLC d/b/a Bia. If you do not agree with these Terms, please do not use the Services.

BackToSchoolPlan does not provide medical advice, diagnosis, or treatment. It is an educational planning aid: it sorts steps you choose and summarises what your ratings have in common. It produces no score and diagnoses nothing, and it is not a substitute for assessment by a licensed clinician. Nothing here should be used to change a treatment, a medication, or a school or workplace arrangement without professional input. Never disregard or delay seeking professional advice because of something you read here. If you may be in crisis, contact your local emergency services or a crisis line immediately.

Acceptance of these Terms

By accessing or using the Services you accept these Terms.

Changes to these Terms

We may modify these Terms at any time. When we do, we will update the date below and, where appropriate, highlight the change. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

Use of the Services

We grant you a limited, personal, non-exclusive, revocable, non-transferable license to use the Services for your own personal, non-commercial use. You agree that you will not:

• copy, scrape, republish, or repurpose content from the Services — including the step catalog, the theme groupings and the pattern summaries, whether by hand, by crawler, or through our public interfaces, and including collection for training data — except as expressly permitted;
• remove or alter any trademark, copyright, or other proprietary notices;
• reverse engineer, decompile, or attempt to derive the source code of the Services, or circumvent any security or access controls;
• use the Services to upload or transmit anything unlawful, infringing, harmful, or malicious, or to interfere with the operation of the Services;
• use the Services in any way that violates any applicable law or regulation.

We may suspend or terminate your access if you breach these Terms.

Professional use

Clinicians, school staff and other professionals are welcome to build plans here and give them to the people they work with, printed or shared, and to keep those plans in their own records. That needs no permission from us. You remain responsible for the clinical or educational judgement about whether a step is appropriate for a particular person; the suggestions are drawn from a general library and are not tailored to an individual’s history or risk.

Intellectual property

The Services and their contents — including text, tools, graphics, design, and the BackToSchoolPlan and Bia names and logos — are owned by the Company or its licensors and are protected by intellectual property laws. You may not use our trademarks without our prior written permission.

Third-party services and links

The Services request suggestions from Bia and may link to third-party websites. We do not control third-party services and are not responsible for their content, operation, or policies. Your use of Bia and any third-party service is at your own risk and subject to their own terms and privacy policies.

Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALL CONTENT IS FOR INFORMATIONAL PURPOSES ONLY. WE ARE NOT DOCTORS AND DO NOT PROVIDE MEDICAL ADVICE. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR RELIANCE ON THE SERVICES, REGARDLESS OF THE LEGAL THEORY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Services.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in San Francisco, California, administered by JAMS under its applicable rules. We encourage you to contact us first so we can try to resolve any issue directly.

Entire agreement and severability

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and the Company regarding the Services. If any provision is found invalid, the remaining provisions remain in full force and effect.
